The Village contracts for Bylaw Enforcement Services with the City of Rossland. Random patrols are done throughout the week and if issues are reported to the Village of Warfield Office, the Bylaw Enforcement Officer will investigate or deal with the problem on their next shift through the Village of Warfield.
Bylaw Notice Enforcement
By bylaw, local governments have the authority to regulate, prohibit and impose rules and requirements in relation to various matters. To enforce the rules and requirements, local governments may engage in a range of bylaw enforcement activities. Most bylaw investigations are initiated because of a complaint. The Community Charter provides that contravention of a local government bylaw that regulates, requires, or prohibits is an offence. Initiating formal court proceedings can be costly, time-consuming and a burden on local government staff.
Under the Local Government Bylaw Notice Enforcement Act (the Act) and the Bylaw Notice Enforcement Regulation (B.C. Reg. 175/2004), local governments may establish a bylaw notice enforcement and dispute adjudication system. This system provides an efficient, cost effective and fair administrative process for managing common local government bylaw contraventions outside of the Provincial Court System.
In September 2022, Village of Warfield Council directed staff to proceed with the establishment of such a system as a tool for the enforcement of appropriate Village regulatory bylaws. The first Village of Warfield Bylaw Notice Enforcement (BNE) Bylaw No. 930, 2023 was adopted by Village Council on March 13, 2023. Bylaw No. 930 was repealed by a new BNE Bylaw No. 950, 2024, which is a consolidated version of the original Bylaw No. 930 and was adopted by Council on June 10, 2024. The bylaw Schedule A identifies the Village’s regulatory bylaws, the various contraventions and sets out penalties for the noncompliance of each contravention.
