Notice of Borrowing Bylaw

Borrowing Bylaws 1258, 2026 & 1259, 2026 — At a glance

At the January 27, 2026 regular council meeting, Council gave first reading to Borrowing Bylaws 1258, 2026 - Bellevue Watermain Looping and 1259, 2026 - Office Upgrades.

The Municipal Government Act requires Council to pass a borrowing bylaw before construction financed by borrowing can start. Each bylaw authorizes an “up to” amount (a ceiling—not necessarily what will be borrowed).

These projects were approved through Council’s budget process, and contracts are secured so work can proceed once approvals are in place. 

If a bylaw does not pass, Council must find a different funding source or adjust the project.

Residents may petition for a Vote of the Electors: 602 valid signatures are required by February 19, 2026.

How to file a petition

Borrowing Bylaw 1258, 2026

TAKE NOTICE THAT the Council of the Municipality of Crowsnest Pass has given first reading to Borrowing Bylaw 1258, 2026 on January 27, 2026.

This by-law authorizes the Council of the Municipality to incur indebtedness by the issuance of debenture(s) in the amount up to $1,500,000 for the purpose of completing Bellevue Watermain Looping.

The Municipality shall repay the indebtedness according to the repayment structure in effect, namely semi-annual payments of combined principal and interest instalments not to exceed twenty (20) years calculated at a rate not exceeding the interest rate fixed by the Province of Alberta or another authorized financial institution on the date of the borrowing, and not to exceed Eight (8) percent.

NOW THEREFORE NOTICE is hereby given by the Council of the Municipality of Crowsnest Pass that, unless a petition of the owners for a vote on Bylaw 1258, 2026 is demanded, as provided for by the terms of Section 231 of the Municipal Government Act, the said Council may pass the said borrowing bylaw.

The deadline for a petition to be received by the Office of the Chief Administrative Officer is February 19, 2026. Second and third readings of this bylaw will be presented to Council at the February 24, 2026, Council meeting.

Borrowing Bylaw 1259, 2026

TAKE NOTICE THAT the Council of the Municipality of Crowsnest Pass has given first reading to Borrowing Bylaw 1259, 2026 on January 27, 2026.

This by-law authorizes the Council of the Municipality to incur indebtedness by the issuance of debenture(s) in the amount up to $2,500,000 for the purpose of the Office Upgrades.

The Municipality shall repay the indebtedness according to the repayment structure in effect, namely semi-annual payments of combined principal and interest instalments not to exceed twenty (20) years calculated at a rate not exceeding the interest rate fixed by the Province of Alberta or another authorized financial institution on the date of the borrowing, and not to exceed Eight (8) percent.

Your right to petition on borrowing bylaws

Because these are borrowing bylaws (Financial Administration), electors have 15 days after the last notice date to submit a petition asking for a Vote of the Electors. One petition is required for each borrowing bylaw presented and may not be combined, even if advertised together. For Bylaw 1258, 2026 and Bylaw 1259, 2026, that deadline is February 19, 2026.

A petition needs at least 602 signatures from eligible electors. Petitions must meet the MGA’s format rules (see “How to petition” below). If a sufficient petition is filed, Council must either not proceed with the bylaw or hold a community vote.

Who can sign?
Eligible electors under Alberta law (generally 18+, Canadian citizen, resident per Local Authorities Election Act - LAEA).

How to petition

  • Use the same statement of purpose on every page.

  • Each signer prints name, address, date, and signs; a witness signs beside each signature.

  • Attach the witness affidavit(s) - see requirements below.

  • File the petition with the CAO by February 19, 2026.

Witness affidavits

A witness affidavit is a sworn statement by the person who watched each signature being made, confirming they personally witnessed the signatures and believe the signers are eligible electors; it must be signed before a Commissioner for Oaths.

Mini checklist for witnesses (show this under the petition form)

  • I personally watched each person sign.
  • Each petition line has the signer’s printed name, address, date, and signature.
  • I signed beside each signature as the witness.
  • I completed one affidavit covering the pages I witnessed.
  • I had my affidavit signed by a Commissioner for Oaths.
  • I attached my affidavit to the petition package before filing.
